Terms of use of Zibrasport Equest

1. In general

1.1. Zibrasport Equest (Zibrasport) is an on-demand, Internet-based platform / service (the “Platform”) for the delivery of content for events, sporting events, competitions and tournaments made available through subscription or single purchase for single purchase to users.

The platform is offered by Zibrasports ApS, CVR no. 32 55 14 40, Erik Husfeldts Vej 7, 2630 Taastrup (“Our”, “Os”, “Zibrasport”, “Zibrasport Equest” and / or “We”).

1.2. These Terms apply to and are legally binding on all users of the Platform (“User”, “User”, “You”, “Your”, “Your”, and / or “You”). Therefore, you must read these Terms of Service carefully before using the Platform. If and / or when you use the Platform, you agree to these Agreement Terms (the “Terms”).

1.3. It is a prerequisite for using the Platform that you read and accept our Data & Privacy Policy .

2. Access to and use of the Platform

2.1. You can access Content by visiting our website, www.zibrasportequest.dk or www.zibrasportequest.com . To access Content, you must either 1) create a user and pay for a subscription to the Platform (“Subscription”) 2) create a user on the Platform or 3) make a single payment that gives access to specific Content.

2.2. You must be at least 18 years of age to create a Platform user. At the same time, you must be at least 18 years of age to be able to make payments on the Platform, including both for standalone Content and to create an access subscription for Content. In addition, you must fulfill the following additional conditions:

  • You must be a resident of Denmark.
  • You must be able to meet a standard credit rating.
  • You must accept that the Platform is provided exclusively in the country in which You are resident. Zibrasport is thus not in any way responsible for costs, violations of legislation or anything that may result from You using or trying to use the Platform outside Denmark.
  • You may only use the Platform for personal and private use, and thus not for commercial or public use, unless otherwise expressly agreed in writing.
  • You must, at your own expense, ensure that You have the required system, equipment and Internet connection.
  • You must register your e-mail address, as all communication between you and Zibrasport is via e-mail communication.
  • You must register your payment information.

2.3. The user is responsible for the accuracy of the information provided when creating a user profile or when purchasing Content. In addition, the User may only enter payment information, including for payment cards belonging to the User.

3. Equipment, systems and connections

3.1. The quality of the platform depends on the user’s equipment, system and internet connection. Before you make a purchase through the Zibrasports website, you must check and make sure that you have the necessary equipment, systems and an internet connection to use the Platform.

3.2. You agree that the availability of the Platform may be affected by Internet or other networks, as well as ISP, electronic, computer or communication problems and failures over which Zibrasport has no control. Zibrasport has no responsibility for such events.

4. Password and security

4.1. The user’s exchange of data via the Zibrasports website takes place in encrypted form via a secure connection. You will be asked to enter the password you have received per registration. email after Your completion of the purchase.

4.2. Platform username and password are confidential information and you must not disclose it to anyone We reserve the right at any time, but with reasonable notice, to require You to change Your password.

4.3. You can use the Platform on two devices at a time (computer, tablet or mobile). If another user tries to log in to the page using your unique password during an active session, that person will be asked if the session is wanted to be taken over, and if so, the current session will be interrupted and taken over by the other user until a new login attempt is made.

4.4. If you suspect that your username and / or password is being used by a third party, you must immediately notify Zibrasport and change your password. If We have reason to believe that username and / or password has been disclosed or otherwise abused, We have the right to immediately deactivate the Platform and / or render the Platform unavailable to you or otherwise prevent continued unauthorized or unlawful conduct. In this case, we also reserve the right to disable your access to the Platform and cancel the Agreement.

5. Processing of personal data

5.1. When you create a user for the Platform, as well as when you use the Platform, Zibrasport collects and processes certain information about you. You can read more about what information Zibrasport collects and how We process the information collected in our Data & Privacy Policy and in Zibrasport’s Cookie Policy .

6. Payment and price changes

It is a prerequisite for accessing Content on the Platform that you register and regularly update your payment information. Information on the payment cards that can be used as payment for the Platform can be found at www.zibrasportequest.com.

6.2. When you register your payment information, register and store a third party, approved according to International Security Standards (PCI DSS – Payment Card Industry Data Security Standard), on behalf of Zibrasport the payment information necessary for the use of the Platform.

6.3. Individual purchases of Content will be paid at the time of purchase, and the payment will be deducted from the debit card you have provided in connection with your registration. The amount will be deducted from your card immediately after you complete the purchase.

6.4. Ongoing subscriptions are paid in advance and the amount is deducted from the debit card you provided in connection with Your registration on the Platform. Payment for the Subscription is automatically charged at the end of each period you subscribe to the Platform.

6.5. You are liable for the payment for the services provided under the agreement. You are also liable in cases where the Platform is left to others, cf. section 62 of the Payment Services Act.

6.6. When you create a Subscription, it will automatically renew on a monthly basis at the end of Your Subscription Period or Bond Period. Zibrasport will continue to deduct the monthly payment from the agreed payment method until you cancel your subscription.

7. Automatic subscription renewal

When you subscribe to a subscription, your subscription will automatically renew on a monthly basis at the end of your subscription period or Binding Period, and We will continue to deduct the monthly payment from the agreed payment method until you cancel the subscription.

8. Binding

There is a 30-day cancellation period for all subscriptions, unless any subscription period is stated on a Subscription, Package or Offer.

9. Termination

If you wish to cancel your subscription, simply change your subscription to a free version under “My Account” on the Website. The termination happens;

  1. At the end of the current subscription period, within which You notify Us that You wish to terminate. If You have a Subscription Period, the termination will not take effect until the end of the Term; or
  2. when You give Us notice in accordance with the provisions on “Changes”, cf. 15 of the Terms, until the expiration of the notice of termination mentioned in these provisions.

If, as a new customer, you have accessed Our Subscriptions free of charge during a trial period according to a campaign (“Free Period”) and wish to cancel or terminate during a Free Period, the information given in “Free period – including termination” applies below.

Please note that the customer relationship exists and that these terms and conditions apply as long as you still have a user account and your customer profile with Us. Learn how to delete your user account and end the customer relationship below.

Deleting a user account is done via “My Page” on the Website, where You delete your account.

If you wish to terminate your subscription ahead of time (for example, terminate your customer relationship with us), you will still have to pay for the remainder of the subscription period or the Binding Period.

We do not refund any fees you have already paid.

10. Free trial – including termination

We might offer new customers a specific trial using Our Subscriptions at no charge (the “Free Period”) in specific campaigns. To use such a Free Period, you or others in your household must not have used the Free Period or other similar promotional offers from Us previously.

The Free Period begins when You have accepted the Free Period Offer and entered Your Payment Information on the Website.

When the Free Period expires, you will automatically be charged for your Selected Subscription at the applicable prices found on the Website, unless you actively cancel the Free Period in accordance with the “Cancellation Right” section below, or terminate the Free Period by the last day of the period. If you regret, the Free Period ends immediately. If you cancel, the Free Period ends on the last day of the period.

To cancel or terminate the Free Period, go to the cancellation section under “My Account”.

When the Free Period ends due to Your cancellation or termination, You will not have access to or have the opportunity to resume the Free Period.

11. Right of withdrawal

11.1. By purchasing access to a Content that is available for the specified period of time, which is stated in the information on www.zibrasportequest.com for the individual event, you have a statutory right of withdrawal of 14 days. The right of withdrawal is counted from the conclusion of the agreement, that is when the order is placed to Zibrasport and expires 14 days thereafter. If you have placed an order on Monday the 1st, you have thus a deadline until the 15th. If the deadline expires on a public holiday, a Saturday, a Constitutional day, Christmas Eve or New Year’s Eve, you can wait until the following week to exercise the right of withdrawal.

11.2. The right of withdrawal is respected if You send your cancellation notice before the cancellation deadline has expired. If you wish to exercise your right of withdrawal, you must notify Zibrasport before you start using the subscription and before the expiry of the 14-day deadline. e-mail to support@zibrasport.dk .

11.3. Zibrasport will refund all payments received from you without undue delay and in any case within 14 days of the date Zibrasport received your cancellation notice.

11.4. Your right of withdrawal is valid only until You use the Platform. You have used the Platform when accessing content that can only be accessed through the selected subscription. You grant, the first time You use the Platform, Your consent to the cancellation right.

12. Intellectual property rights

12.1. All content in the Platform is protected by Danish and international copyright laws. All material and Content that forms part of the Platform is owned or licensed by Zibrasport or Zibrasports Affiliates.

12.2. Zibrasport grants you a non-exclusive, non-transferable and limited right to use these rights for personal and private use only (and not for commercial purposes), provided that You are not, but not limited to:

  • – copy, publish, reproduce, rent, publish, transmit, distribute, transmit or make the Platform Content available to the public or authorize others to do so;
  • – downloads, forwards or shares content from the Platform, accesses content from a device that is not registered by you, or charges a fee for viewing the Platform; and
  • – circumvent, modify, remove, decompile, disassemble, modify or otherwise tamper with security or encryption or any other technology or software that is part of the Platform.

12.3. Violation of these rules and violation of the rights of Zibrasports ‘or Zibrasports’ affiliates will always be construed as a material breach of the Agreement and Zibrasport may immediately block Your access to the Platform or otherwise prevent continued unlawful conduct.

13. Security and responsibility

13.1. Do not attempt to bypass Zibrasport’s security system or attempt to test the Platform’s security system.

13.2. You may not use the Platform in any manner that could damage, close, overburden, impair, or violate other users’ use or experience of the Platform. This includes, but is not limited to, transmitting or transmitting material containing software viruses or other computer codes, files or programs designed to damage, interrupt, destroy or limit the functionality of any computer software or hardware or equipment connected to it directly or indirectly to the Platform.

13.3. You must not attempt to gain unauthorized access to any system, network, content or information on the Platform or systems that form the Platform. Also, do not attempt to access any material or information not intentionally made available from the Platform.

13.4. Violation of the above will always be considered a material breach of the Agreement, and Zibrasport may immediately block your access to the Platform or otherwise prevent any continued unlawful conduct.

13.5. Zibrasport does not guarantee the accuracy or completeness of any content, information, Content or other material made available on or through the Platform.

14. Links from zibrasportequest.com

14.1. Violation of the above will always be considered a material breach of the Agreement, and Zibrasport may immediately block Your access to the Platform or otherwise prevent any continued unlawful conduct.

14.2. When you use the website www.zibrasportequest.dk / zibrasportequest.com , it may contain links to third party websites. Zibrasport has no control over these websites and assumes no responsibility for them or for any loss or damage, nuisance or inconvenience that may arise from your use of these. 14.2. When You Use the Website

15. Changes

15.1. Zibrasport reserves the right, at any time, to make changes to these Terms of Service as well as the Subscription Content that you subscribe to. Changes will be made via www.zibrasportequest.dk / zibrasportequest.com. Zibrasport recommends that you keep up-to-date by visiting www.zibrasportequest.dk / zibrasportequest.com.

15.2. We give you at least 30 days notice by e-mail or publication on www.zibrasportequest.dk / zibrasportequest.com if there are any changes in prices or content in Subscriptions. Significant changes are notified individually by email. For subscriptions with a binding period, the agreed price applies throughout the binding period. However, we may change prices at a shorter notice or during the binding period if Our costs of making the Platform available increase as a result of changed taxes, fees, exchange rate fluctuations, changes in prices to third parties, decisions by the authorities or legislative changes or other regulation, and the price increase. of the subscription corresponds to this increase.

15.3. If You are unable to accept the price change, You have the right to cancel Your subscription with effect from the date the change takes effect, if Zibrasport has received notice of this at least three calendar days before the change takes effect.

15.4. Changes in prices, as described above, also include the introduction of new prices, fees, etc.

16. Transfer

16.1. This Agreement applies only to individual Users and You may not assign the Agreement or any portion thereof to any third party. Zibrasport has the right to assign all or part of the agreement to a third party.

17. The Agreement

17.1. These Terms of Service, your information and Zibrasport’s Data & Privacy Policy and Cookie Policy form the entire basis of agreement between you and Zibrasport and supersede all prior agreements, both written and oral.

18. Force Majeure

18.1. Zibrasport is not responsible for failures, crashes, cancellations of events or any other failure to comply with these Terms and Conditions caused by events beyond Zibrasport’s reasonable control.

19. Interruption

19.1. Should any provision of the Agreement between you and Zibrasport be invalid or unenforceable, such provision will in no way affect, invalidate or prevent enforcement of the remaining provisions of the Agreement.

20. Disputes, complaints and contact

20.1. In the event of a dispute arising from the agreement, you can appeal to Zibrasport at support@zibrasport.dk . As a rule, Zibrasport will decide on the case within one month of the complaint being filed. If an amicable settlement of the case cannot be reached, a complaint may be filed with the Competition and Consumer Agency’s Center for Complaints, Carl Jacobsens Vej 35, 2500 Valby. You can complain to the Center for Complaints Solution via www.forbrug.dk .

20.2. The agreement is regulated and interpreted in accordance with Danish law. Disputes may be brought before the Danish courts according to the rules in force at any time.

Zibrasport Equest is an equestrian community for horse lovers, equestrian enthusiasts and others interested in equestrian and equestrian sports. Comments, debate and posts are welcome as long as they are in a good tone and with respect for other people.

The Editors reserve the right immediately to remove spam, advertisements, comments and posts that do not comply with the following code without the written code of Zibrasport, without notice and for their own business:

  • Comments and submissions must comply with copyright law and other Danish law.
  • Comments and posts may not contain links to advertisements or tags.
  • The site must not be used for marketing purposes.
  • Spam and repetitions of identical comments and posts will be deleted.
  • Links to articles with linked comments are welcome, but posts and comments that only contain links are considered spam.
